This is why in his resignation he separated munus and ministerium in his resignation. Even Marshall agreed this was an error, and added that since Pope Adrian V was elected while yet a Deacon, he was Pope not through sacrament, but only by election. Their argument is you can't have 2 popes simultaneously. Listen especially 40-55 minutes.
This is the same argument that has been around since just after Francis was elected. Does it unessesary follow that even if Benedict had a flawed understanding of the nature of the Papacy ( which is debatable).... his resignation is invalid? Not a single Cardinal has come out in support of this idea after nearly a decade of the argument being put forward. Mazza argued that this does not nessesarily mean that his theory is wrong. Even if we agree, it doesn't vacate the substantial witness that the Cardinals are of one mind regarding the legitimacy of the resignation I leave it in the hands of God. Much more intelegent, orthodox, faithful Catholics who understand the arguements, have assured me that Francis is indeed Pope. If I am in error I leave it up to God to straighten it out.
